us. i'm jon kelley. >> i'm laura garcia-cannon. it was nice to see the children growing up right there in the white house. >> the excitement just palpable last night. it was a slim win for president obama but it was not a long night like a lot of people had expected. just before 9:00 local time, president obama declared the projected winner. that is even with the battleground states. >> even with the battleground states that were still outstanding. in the meantime, we will hear from romney's camp as he eventually gave his concession speech as well, thanking his party as well, paul ryan, his wife, his sons. all families giving up so much. >> committed to that. two years. hard core, hard fought battle. >> exactly. it is time to get to work as well. the celebrations continued with so many people. played out. pretty exciting. >> reporter: good morning, everyone. despite the fact that there is still some vote counting going on, here's what we know. president obama projected to have won both the electoral vote and the popular vote in this very tight race. a burst of emotion at the obama victory party in chicago. the moment the race was called. early this morning, celebrations around the country from new york to los angeles and the white house where president obama will spend four more years. >> whether i earned your vote or not, i have listened to you. i have learned from you. and you've made me a better president. we are not as divided as our politics suggest. we're not as critical as the pundits believe. we are greater than the sum of our individual ambitions and we remain more than a collection of

red states and blue states. we are and forever will be the united states of america! >> reporter: his speech came after a call from mitt romney who told supporters in boston he gave it his all and insists that washington must come together. >> the nation, as you know, is at a critical point. at a time like this, we can't risk partisan bickering. our leaders have to reach across the aisle to do the people's work. >> give back to america through public service. that is a legacy that we honor and applaud tonight. >> reporter: the president won the slim majority in key states, ohio, pennsylvania, wisconsin, iowa, colorado, new hampshire, virginia and nevada weren't called until early this morning, after he was declared the projected winner. still outstand, florida, where at 2:00 a.m., people were still in line voting.

not only does florida still need to count those votes but also we're told thousands of absentee ballotings ths that haven't eve touched yet. that's the latest from us this morning, back to you. he doesn't like to make predictions but he called this race with expert precision. he is our own political analyst. what a night. jim, you're on the money. >> what a prediction. we put you in the hot seat yesterday. we asked you to make your own prediction. you nailed it. tack a look. >> my prediction is obama will win with 303 electoral votes. >> what do you know, obama won with 303 electoral votes. what do you say about that? >> the old saying goes that even a broken clock is right twice a day. i have to thank nate silver for that because i relied heavily on

his projections and simply, you know, looked at what he had said and so he is absolutely right. we're still waiting on results from florida and they may skew my results but, you know, for the time being i look pretty smart which is nice. >> you are very smart, so humble. we're lucky to have you with us. how about this, obama won wisconsin. not a surprise. paul ryan's home state. he also won massachusetts. romney country there in terms of governor. what does that say? >> in this particular race, i don't think the romney/ryan camp was counting on massachusetts. i think they knew wisconsin was a battle. i think ryan was picked mainly for his budget knowledge and the fact that he really -- the conservatives really liked his budget plan. so it was more of a national vice presidential choice. he's still very popular among republicans. we may have to look for him in

2016. oh, no, i brought up 2016. >> already, already. obama's there for another four years. what's his next move? >> well, immediately, he has got to worry about the fiscal cliff that's looming in january without some agreement on budget, we're going to face draconian cuts so he's got to get to work immediately. >> we are going to be talking to you throughout the morning, don't go anywhere. >> maybe jim will get us a lotto number pick by the end of the day, we could use it. one of the biggest issues is proposition 30. the governor's tax initiative to help fund education. the california voters passed prop 30. governor brown expected to speak later this morning. "today in the bay's" christy smith live in sacramento with the expectations for that.

>> reporter: governor jerry brown told his supporters late last night, i know people have their doubts. can you go to california voters and ask them to vote to raise taxes on themselves. well, he did. and, as you said, it looks like it passed. governor jerry brown signature tax measure proposition 30. he spoke with supporters at the hotel near the capital last night. he expressed confidence it would pass. looks like he was right. enjoyed support in places like san francisco and coastal areas but not so much in rural areas of the state. this measure has been the governor's focus for two years. if it would have been defeated, brown said nearly $6 billion in budget cuts would fall mostly on public schools. >> i'm very optimistic. this -- no, it looks good. we're ahead. and we're going to -- god willing, we're going to stay ahead. >> reporter: now, what prop 30 does it raises sales tax for

four years and increases income taxes on higher wage earners in the state but critics have said that schools are really put out front on this when the money would have gone to many other things, that state leaders really needed to fix the broken system before asking for millions dollars that ultimately they can go ahead and spend on anything they want. governor brown expected to speak on those results at 11:00 this morning here at the state capital. reporting live in the state capitol, christy smith, "today in the bay." one measure would allow more karroum. t the other would increase minimum wage. >> reporter: one, a defeat, look like a defeat for gamblers. the other one, a huge victory for minimum wage earners here in san jose. let's talk about measure "d." that's the minimum wage measure in san s leading with the majority of precincts reporting.

with the presumed passage of measure d, the hourly rate will go up $2 an hour from the state rate of $8 to $10 an hour. those for measure d argue this was a moral necessity given how expensive it is to live in silicon valley. others say it will hurt the market as higher wages force companies to cut back on hiring. measure e. that's the measure. around 60% have said no. measure e would have allowed san jose's two card rooms to add more gaming tables resulting in more tax revenue for the city. proponents saying as much as $5 million more a year for things like plisholice, fire and libra. opponents argue card rooms would have added more crime.

coming up, reaction from mayor chuck read not only about those two measures but about council woman rose herrera winning last night. that story coming up. meantime, reporting live here in san jose, bob rodell "today in the bay." let's get the weather out there. the reality of fall is setting in, getting cooler now. >> we've got some sharp turns ahead in the weather department. good morning. starting with your country conditions. we're at 48 degrees in napa. here in san jose, 57 to start you out. on a post election wednesday. hopefully you got out there to vote. temperatures drop off 10 to 15 degrees. and that fog and drizzle, it's back at the coast. rain arrive also as we head through tomorrow, as well as jacket weather. and then friday, temperatures are only going to be in the mid-50s across the board. rain on the way and low snow levels. we're going to clear out just in time for the weekend but we want to make sure you're ready for

very slick conditions over the course of the next days. very potent storm system moving in. lots of sunshine for the second half of your day inland. 58 bay side at the coast. you'll be at about 65 degrees. your full forecast, that seven day, ready to go in the next report. first, let's see about the roads. >> we do have some low clouds and fog drifting around, affecting the temperatures and your drive potentially. here in san jose, you see a little glow. visibility's all right. just over half a mile in most spots. as you come into san jose, experience that through freemont, so just watch out here. here's the maps showing you, the circle's where our camera's are, this is heading up, you might find a lane or two blocked, but not a big deal as far as overall speeds go throughout the south ba you're starting to see slowing out of the alta mont. we'll end with this look he'd as we look across the bay.

welcome back, everyone. it's 5:14. some of our nonelection top stories this morning including oakland police warning residents of a recent abduction attempt. on monday, a suspect allegedly grabbed a 14-year-old girl near 103rd avenue and international boulevard. he then tried to pull her over to a waiting getaway car but she was able to escape. both suspects were seen speeding away in a late model red pickup truck with an extended cab. and this morning, students across contra costa county will take part in a drill. children in all day care centers and both public and private schools will be participating in this. the drill was meant to simulate the country's response in the event of a hazardous emergency situation. president obama collecting millions for his campaign in northern california.

but he spent nearly none of it in the golden state. rightfully so, silicon valley -- >> the president came here for funds but didn't really campaign here. he knew he'd win california. whether he campaigned or not. silicon valley would like its recognition. one of high tech's top priorities is immigration reform. allowing more highly skilled educated workers to come to america. a little trivia for you. no company in california donated more money per employee than google. as a general rule, wall street supported governor romney but, as i mentioned yesterday, anticipated mr. obama would be re-elected. so don't look for any shockers here. next on the agendagenda, fiscal cliff, 55 days remain till that. our victory for twitter this morning. a number of tweets went to the hundreds of thousands per minute. president obama first to acknowledge his win on twitter

gilroy. average for the time of year. temperatures are cool to start. full deck of clouds. 56 in san francisco. 52, napa. plenty of low clouds in the san francisco bay. south bay, 47. crisp in gilroy. where you hit 92 yesterday. temperatures are going to be more traditional to the fall as we head through this afternoon. low pressures races in. this is what we're expecting. 15 to 20 degree drop in temperatures today. rain and wind arriving for the second half of your thursday. snow levels. the very cold air traveling behind that front moves in on friday. that's going to drop your snow level also to 2500 feet. yes, it's the weekend. a lot of people want to head to sierra nmpl 9/11. want to keep in mind, you have to have chose chains with a lot of active weather near the tahoe region so it works out like this. the snow levels fall to 2500 feet.

expecting possibly up to a foot of flashy powd up there. very slick. wind gusts at 40 miles per hour. a perfect fall afternoon. 67 in san francisco. and then the rain arrives as we head through tomorrow. look at our temperature. we're going to be back in the 50s. you'll probably have to use your heater. not too bad. a warm-up on the way. monday into tuesday. the 60s return. we're done with that record breaking heat at least for a while. how are we doing on the roads, mike? >> with those changing conditions, that's going to be an issue for visibility because that brings some of that fog out again. here we have freemont. our rooftop camera. let's hit the roadway across the parking lot. we can barely make it out over 10 minutes ago. now we're seeing a little clearing. that's 880. the freeway itself moves freely. mission boulevard, there is a little bit of visibility issue coming down through the area south of the dunn barton bridge.

680 moves nicely. keep that in mind, it's fine coming the dublin interchange and west 580. although you see a little slowing now building out of the altamont pass. typical pattern for this being a wednesday. farther north with vas coroad. an accident there, may affect your travel through the area. chp on the scene. may be traffic control. a major intersection coming out of byron and brentwood as well. a much better view here. you couldn't even see the university avenue crossing, now we can see a couple of miles. back to you. naturally, there was some controversial issues on the ballot. voters asked to legalize the recreational use of marijuana. >> could this start a trend? voters in washington state and colorado showing their support to legalize the recreational use of marijuana. one thing is for certain, these states have set up a showdown with federal authorities since marijuana is still considered an

illegal drug. what's interesting here is colorado's democratic governor opposed legalization. so he isn't all that excited. colorado's amendment will allow adults over 21 years old to possess up to an ounce of marijuana. though using the drug publicly is banned. it also allows people to grow up to six marijuana plants in a private secure area. washington's measure establishes a system of state licensed marijuana growers and stores where adults can buy up to an ounce. estimates show pot taxes could bring in hundreds of millions of dollars a year. now, on the flip side, oregon voters rejected legalizing marijuana. voters in arkansas rejected a measure to legalize medical marijuana. in the state of massachusetts, it's now legal to use marijuana for medicinal purposes. >> all right, thank you very much. it is 5:20.

voters in alameda county deciding who will fill the district 2 seat vacated by nadia locker. she had some issues. robert bonto taking this one. it was a democratic race. also state assembly up for grabs there. the votes are in and it is bill quirk. he takes that seat in district 20. the time now is 5:21. >> a lot of numbers to look at this morning. >> long distance shots. more election coverage coming here. a crowded race for mayor of freemont goes to city councilman bill harrison. harrison won a race that included a diverse field of candidates including a 19-year-old usc student and freemont native aziz akbari. >> here's a look at some local congressional races decided last night.

welcome back. it is 5:24. voters had a lot to decide in oakland yesterday. incumbent parker has fended off council woman jane brenner. >> interesting, most city council races will have to be decided by choice voting there because none of the candidates received more than 50% of the vote. now in a district one, dan caleb currently leads there. in district three, sean sullivan currently leads but barely. >> also in district five, noelle galler leads. rank choice voting can change everything.

if you don't hit that 50% mark, you have to do it over. >> district seven, incumbent reed will keep his seat. rank choice voting needed to decide the at large seat. rebecca kaplan currently leads della fa wen that. who gave up his position so it will be interesting to see. >> he's been around for a long time so interesting to watch. now turning to the race for two board of supervisor seats in san francisco. voters there deciding on seats in district one and district five. >> district one incumbent supervisor eric mar cruised to victory. in district five, incumbent supervisor was defeated by her challenger london breed. >> san francisco board of supervisors district one incumbent eric mar facing two challengers here. we'll get back to those results coming up. we're working on that. let's check on the weather. christina loren is here. the temperatures are dropping. >> we've got a great looking day

shaping up. finally getting temperatures traditional to this time of year. temperatures in the 70s. inland, 74 degrees. at the coast, 65. now, over the past couple of days, we've had absolutely no fog. even in daily city. today, everything changes. mostly cloudy conditions. all the way through san jose. that's going to keep your temperatures down for today. the rain arrives. leave that umbrella at home for today. we'll tell you exactly when coming up. first, want to check on that drive. >> i copy off your paper, as i do en times on days like this. the fog and the drizzle affecting your drive. here's the bay bridge. it's fine as far as the volume goes. over the span, you're okay. you see the lights on the horizon here. let's take our camera. you can see, i showed you how we saw all the way up the east shore freeway coming off the curve. now we can barely make out the lights coming past the racetrack and i can't even make out the city lights there either so we're losing visibility once again. of course chp issued a travel

the projected winner of the race for president and tracie potts is live at the site of the victory in chicago, illinois, with more on how that night played out. >> each sure the energy was incredible out there. >> incredible. because these were people who had fought hard for a president who, quite frankly, had a 50/50 chance according to polls of being re-elected. he had a little bit more than that in the margin of the battleground states and it turns out he took all of them except for one, north carolina, and actually florida is still in flux this morning. but the people were up so late this morning, still voting in florida. the president took the stage last night to accept the presidency for four more years. saying whether or not he had earned the vote of everyone in this country, he listened, he learned, and it made him a better president. he also said we're not as devilded as pundits seemed to think although the numbers seemed to show a very divided nation. mean type, governor romney in

boston conceding this race. he said he gave his all. said that the nation's at a critical point that we can't risk partisan bickering. the president spoke about that as well. saying he wanted to talk to governor romney about some ideas of how they can do that. no word yet on when or how that might happen. but we do have president obama as the second term president this morning, after winning his 300 electoral votes. >> president obama holds on to his address for four more years. he still has a divided congress. "today in the bay" has some insight from a political expert. >> the polysi professor from the university. it's hard for anyone to make change if you don't have

support. democrats hold on to their majority in the senate, not in the house. >> it really means there's not going to be a lot change in congress. in terms of the partisan balance, it's basically going to be the same as it was before. in the senate, you need 60 votes to do anything. because basically they'll filibuster anything. and so it's going to make it very tough i think to continue to get anything done. hopefully, obama is able to reach out and maybe get some votes from the other side of the aisle because we have some important economic decisions looming. the fiscal cliff in january, something that needs to be taken care of right away. we'll have to see how the republican majority in the house responds to the president being re-elected. if he can convince some of them that we have to work together, we've got to get things done, maybe they'll make progress. >> the economy of course is the number one issue. any surprises for you? we talked a little bit that you're surprised he has the lead in florida, obama.

>> it suggested to me that romney had a slight lead in florida. it was always going to be very close. they're trying to undermine my 303 prediction i think. a couple of other surprises. in indiana, even with some of the comments that murdoch made, i was surprised he actually lost that race. because indiana's pretty heavily republican. and i think some of those voters may regret that they dumped dick lugar in the primary now. because dick lugar probably would have won that race. >> and there's so much talk that sandy helps obama win this. do you think this hurt romney this happened? >> it may have a bit. hurricane sandy afforded the president an opportunity to look presidential and his response was widely hailed by many of the governors in the states that were affected, especially chris christie, being pleased with the republican's response. i think that certainly didn't

hurt. he's got the president and eebs got the experience. >> we'll talk about the marriage and legalizing marijuana in our next go around. >> one of the biggest decisions voters had to make whether to approve a tax increase to fund education. this morning, it appears prop 30 has passed. 54% to 46%. governor brown expected to react to the victory later on today. i'm sure he's going to come out a very happy man but also very relieved. this was tough. >> yeah, good morning to you, jon. this was a huge victory for governor brown. at an election watch party, he told supporters basically in the end proposition 30 sold itself. that californians believe in schools. they believe in education. and the capacity of government

to make wise investments. a few hundred prop 30 backers were in a very good mood as the measure gained majority support. brown was able to overcome long time anti-tax sentiment here in california. he billed it as a tax hike to go ahead and rescue schools. rejecting it would trigger $6 billion in cuts to include things like higher college tuition and a shorter school year. brown told supporters he knows there were doubts and questions but he remained confident. >> we have the vote of the people. the only place where he said let's raise our taxes for our california dream. >> reporter: it raises the income tax on those making over $250,000 a year. critics have argued that prop 30 put schools out front when, in reality, the money would go

elsewhere, in addition to schools. that the state really needs to work on reform before asking what amounts to a $50 million bailout. a long road for the governor to get here. he is expected to speak on these results at the state capital this morning at 11:00 a.m. reporting live, christy smith, "today in the bay." >> voters in the south bay had to decide whether to raise the sales tax. "today in the bay's" live in san jose with a look at the results of the measure a. >> reporter: good morning, laura. goods and services are going to cost a little bit more because it looks like right now measure a is going to pass. let's show you the latest numbers. this was the majority of the precincts reporting. 56% of voters saying yes. close to 44% said no. so what does measure a mean with this passage? that means there's an eight cent sales tax increase. raising the sales tax here to

8.5%. that would be the third highest sales tax in the state. keep in mind, this is below what we would have with prop 30. assuming that it passes as well. so the state tax will be a little bit higher if prop 30 passes as well which right now it looks like it will. right now measure a would raise $50 million annually for the next ten years. and that money would be going to things like law enforcement, public safety, emergency room services, health care for low income children. and housing for the homeless. proponents of measure a said it was necessary to get measure a passed so it could help make up for recent cutbacks in county government and we've seen this on the city level as well. speaking of the city, we're outside of mayor read's home here. we'll speak with him to get his reaction to council woman herrera's re-election who's an ally of his. also, his reaction ton the defeat of the card room measure

and the passing of the minimum wage hike here in san jose. it is 5:38 right now. we check back in with meteorologist christina loren who has the mother nature proposition for us. >> she's proposing right on average for this afternoon. but hey we're back to our extremes as we get through the end of the week. temperatures dropping like a rock. hard to believe we were in the 90s in some cities for the first full week of november. it's cool out there to start in some of your cities so pull out your jacket. take it to your visibility. because these are dropping like a rock as we speak. you're down to just a half a mile here. expecting more fog to develop as we head through the next couple of hours. it will be at its worst between 7:00 and 9:00. we continue that future cast. sunny conditions, left with the 70s, with limited sunshine for the first part of the day. 74 degrees inland today.

65 degrees at the coast. we're going to time-out that very potent storm system that's tracking closer and closer to the california coastline. first, want to get you out that front door on a post election wednesday. >> hey, we're looking at that fog you're talking about. the low clouds, potential for drizzle. we're looking at san jose, 101, kind of a glowy look, as the burst starts. just getting that first burst underneath that 680 interchange. you don't see yellow slowing up in that section. just kicking off from some surface streets. it's pretty good through the south bay. this will change dramatically over the next 20 minutes. 580 slowing, speeds into the 50s through livermore and into the dublin interchange with more slowing right at 680. we'll look at a live shot. see how things are shaping up across the bay. for the san mateo bridge. picking up the volume but no slowing. oakland, good visibility and good flow. northbound with those tail lights, guys.

welcome back everybody on this post election day. take a look at some of the other top stories this morning. the moraga school district holding a meeting to discuss a lawsuit. the student suing the district and three former administrators for negligence and emotional distress related to sexual abuse she suffered at the hands of two teachers. just last week, the district responding that her own behavior led to that abuse. district officials will meet at 7:30 this morning to discuss the issue. >> the california supreme court tackles the issue of online privacy today. consumer groups say online stores like itunes and ebay are collecting too much personal information during transactions. a state law adopted in 1992 bars retailers from collecting information like addresses or zip codes that are unnecessary to verify credit card purchases.

>> all right. on the national scene, it is history in the making this year on a hot button issue. we're talking about same sex marriage. some voters out on the east coast, they're saying yes. "today in the bay" has all the latest results. >> they're saying i do. maine and maryland have become the first states to approve same sex marriage by popular vote. these results there mean they're now the seventh and eighth states to allow same-sex couples to marry. washington state also voted on a measure to legalize same sex marriage. so that race is still too close to call at this point but it does have a slight lead with 52% in favor of gay marriage, to 48% against. and one more gay rights victory. minnesota voters defeated a proposed constitutional amendment that would have banned same sex marriage in that state. now the races in maine and maryland were relatively tight. no surprises, the supreme court is now expected to consider the

you're taking the little ones to school this morning. area of low pressure's racing towards the coastline. the changes work out like this for today. 15 to 20 degree drop-off. tomorrow, the second half of the day, the rain and gusty winds arrive. and then snow levels falling to 2500 feet on friday. what's really interesting about this storm system is it's not packing a whole lot of moisture. maybe half an inch, three quarters of an inch of rain in the north bay. not expecting all that much in the south bay. what it is packing is some very cold air. hence the very low snow levels. which is very absurd when you consider the fact we are near records all week long so far. friday into saturday, that's when it's going to be the most active. sunday into monday, things relax. temperatures are going to be nice. let's check on that drive. >> good morning. let's take you for this live look at the bay bridge. the toll plaza starting to back up a bit. see these cash lanes. that's indicative of the amount of traffic coming through the

area. the east shore freeway getting more crowded as well. we see the fog continues to drift through the area, impeding some of our visibility. we can see for two miles the stretch we're looking at. you can kind of make out the silhouette there. the smooth drive westbound. coming out of the north bay, you might have an issue. coming down the east shore freeway, that's not a concern. but farther north, there's some typical fog coming in, american canyon, out of fairfield, over to highway 37. and toward the raceway as well. so just keep that in mind throughout parts of santa rosa as well. we're looking at far south bay where traffic moves smoothly. a good thick patch of fog drifting through as well. we see the slowing on the map. and we'll show you the live shot as well through san jose. 101 really packing it in. and low clouds are hovering as well. back to you. >> continuing our political coverage. returning to washington.

senator dianne feinstein. a well-known bay area name. she beat elizabeth emken for the senate seat. >> pelosi will keep her 12th district seat. she easily beats republican john dennis there, taking 85%. >> democratic incumbent john garamendi trying to hold on to his district three seat. facing kim vann. 54% there. >> democratic incumbent mcnerney holding off a strong challenge. >> incumbent democrat pete stark has lost his district 15 seat to fellow democrat eric swalwell. we caught up with the new representative. >> there is a lot of excitement here at the campaign headquarters. about 150 people have shown up to show their support and they are so excited about the result.

the 31-year-old is the dublin city councilman and prosecutor with the district attorney's office. and now he has officially unseated incumbent pete stark. >> feel very good. i feel like the support and the votes we're seeing now reflect the effort that's right behind us here. so many people have invested in our campaign with their hard work and just being out there and bringing their friends in, their neighbors and their family. >> i voted for pete stark and the reason i voted for him is because i think -- his allegiance is to the people. he supports legislation that benefits us. >> reporter: pete stark is 80 years old and has served in congress the last 40 years. we did try to talk to stark. he would not grant us an interview. he got in his car and he drove off. now, this is the new 15th district. it has been redrawn and it's now

welcome back. to the hotly contested race in oakland for the at-large seat for city council. results so far show rebecca kaplan with 46% of the vote. in order to win with rank choice voting, kaplan had to reach more than 50%. that means a second round has to be counted. kaplan tell us she's optimistic about her chances of winning. del la fuent an says he's not ready to throw in the towel. >> i feel good. i will continue work in oakland. you know, it's like it's not other till it's over.

business unfriendly city to a place to make money. now, as you -- the employee tax replaced by a gross set tax. that is, you're no longer taxed on how many people you have, you're taxed on how much your business makes. if a tech company with lots of employees but little money to show for it like twitter, that's great for them. if you get lots of income, this may not be a big win for you on e. wall street generally greeting the election results with a shrug. the financial markets pretty good prediction really. that's why the futures markets exist after all. news agencies were playing the presidential race fairly close. markets kind of knew otherwise. the markets are much higher today than they were when mr. obama took office. if you're the dow, you are better off than four years later. the fiscal cliff, 55 days remain. >> that's right, that's right.
